POLICY ON LAND

1/ The land rental:

a) The unit price of land rental: Unit price of land rental/year equal 50% unit price of land rental is regulated by Government. However the least unit price equals 0,25% land price according to land using purpose promulgated by People’s Committee and is stable in 5 years

b) Exemption, reduction of land rental:

- To exempt eleven (11) years for investment projects are not in the List of business, field of encouraging investment.

- To exempt fifteen (15) years for investment projects are in the List of business, field of encouraging investment.

c) To be entitled to exempt of auction of renting land use right.

2/ The rights of Vietnamese organizations and individuals from all economic sectors, Vietnamese living abroad, foreign organization and individual, domestic and foreign invested capital enterprises, participants of business co-operation contract as per the Investment Law having operations on tourism, services, production, business of commodities in Phu Quoc Island:

a) To be entitled to transfer land use right, land lease, land sub-lease for land with construction of technical infrastructure composition in the Island, of the enterprise for investment, construction and business on composition of infrastructure as per the corresponding regulations of the law on land, for building workshop and architectural works to serve production, trading on commodities, services;

b) To lease or purchase workshop, ground-warehousing built in the Island to serve production, trading on goods, services as per the contract signed with the enterprise for investment, construction and business on composition of infrastructure.

c) Using with pay towards technical infrastructure composition works, services and public welfare works in the Phu Quoc Island including: system of communication roads, seaports, supply of electricity, supply of water, drainage, liaison information, treatment for liquid waste and substance wastes… and other public services in the Island as per the contract signed with enterprises for investment, construction and trading on composition of infrastructure;

d) To be entitled to enjoy other legal interests as per regulations of law on land, investment and other legal normative acts of Vietnam Law and follow to regulations of International Treaties that Vietnam signed or adhered to.

3/ Organizations, individual invest in the construction and trading on infrastructure composition (functional zones, technical infrastructure composition works, public welfare and service works) have the rights:

a) Apart from the right enjoyed as per regulations of VN Law and International Treaties that Vietnam signed or adhered to, the enterprises operate in Phu Quoc Island are entitled to enjoy further the following rights:

- To use works of infrastructure composition, public welfare and services generally serving the Phu Quoc Island such as communication road, post, airport, technical infrastructure system, lighting system, electricity supply, water supply, liaison information as per the agreed price with the enterprises for infrastructure business of the Island;

- To be entitled to enjoy preferences on investment as regulated in this Statute;

- To be entitled to mortgage the value of land use right and property attached on land during the remaining term of land use towards the land entrusted with collection of paid-up land use fee without origin from the State Budget, at the credit organizations to be operated in Vietnam as per regulations of VN Law.

b) To be the object that Phu Quoc Island Development Investment Management Board to lease land or to re-entrust land with collection of land use fee, re-hand over land without collection of land use fee as per corresponding regulations of the law on land, in order to invest in construction and trading on technical infrastructure composition, public welfare and services works in the Phu Quoc Island.

c) To be entitled to transfer the land use right and property attached to land during the term of land lease or land sub-lease as per regulations of the law, in compliance with the purpose of land use of the project invested. In case of having change upon the initial investment purpose of the project then the transfer of land use right and property attached to land is only carried out after obtaining the approval from competent agencies.

d) The collection of money for using works of infrastructure composition of functional zones, works of technical infrastructure composition, works of services and public welfare in the Phu Quoc Island, carried out by the enterprise for investment, construction and trading on composition of invested infrastructure, as per the contract signed with the lessee;

đ) Construction of workshop, ground-warehousing on the Island as per the detailed planning for sale or for leasing;

e) Evaluation for the sub-lease of land having built composition of technical infrastructure, the land use of technical infrastructure composition works, public welfare and services works in Phu Quoc Island as per agreed with Phu Quoc Island Development Investment Management Board; evaluation for lease or sale of workshop, ground-warehousing and money for services;

f) To be entitled to allow the economic organization, Vietnamese settling abroad, foreign organizations, individual; the foreign invested capital enterprise having financial capability and experiences to call for funds to invest to lease, sub-lease one part or the whole area of land not to be leased in order to sub-lease land, call for capital as per the corresponding regulations of the law on land; 

   4/ Economic organizations, Vietnamese living abroad, foreigners permanently residing in Vietnam, enterprises with foreign invested capital, foreign organizations and individuals are entitled to invest into construction of dwelling-house for sale or for rent, sub-leasing or transfer of land use right having built infrastructure in Phu Quoc Island as per corresponding of the law on land. Vietnamese living abroad is entitled to purchase dwelling-house attached to the land use right in Phu Quoc Island. Foreigner permanently residing in Vietnam and foreign investors are entitled to purchase dwelling-house and to lease resident land for long-term in Phu Quoc Island.
